'Precedent' in this situation doesn't have to mean anything other than "it has literally never happened". 'Precedent' is not constrained only to its meaning in law.
Furthermore, precedent is a thing in continental law as well, as written law still needs to be interpreted and interpretation sets precedent for future interpretation.

And United have bought/sold players to the Spanish League before. Can't believe that someone would make such an amateurish mistake. There has been a big **** up somewhere and the fall out will continue throughout the international break imo ...

Well yes, there's precedents everywhere, because there's always new situtations that need to be interpreted, but they don't actually create law outside of UK&US and some former UK colonies.
But you could be right, he may not have used it as a legal term.
Worry not, if it goes through, you'll get to enjoy at least half a year of De Gea being booed by his new fans, since Spanish meda already dig out the quotes of him saying he would never join Real Madrid.
